GENERAL RENTAL TERMS AND CONDITIONS

BaoVans Rental Services S.L.U. These General Terms and Conditions govern the contractual relationship between the renter (hereinafter, the “Client”) and BaoVans Rental Services S.L.U. (hereinafter, “BaoVans”) in relation to the vehicle rental services offered by the company. The signing of the rental agreement implies full, unconditional, and unreserved acceptance of these conditions, which shall prevail over any other verbal or written agreement not expressly authorized by BaoVans.

1. ACCEPTANCE OF THE AGREEMENT AND DELIVERY CONDITIONS

By signing the contract, the Client accepts all general and specific rental conditions, which shall be considered an integral part thereof. Vehicle delivery will take place at the time requested by the Client in the online booking form. If the Client wishes to collect the vehicle earlier than the agreed time, an additional fee will apply according to the current rate. The contract will end when the Client returns the vehicle, keys, and documentation at the location and time stipulated in the contract. Return outside opening hours will not be accepted if the Client has contracted basic coverage. In case of early return, no refund will be given. If for reasons beyond BaoVans’ control the Client does not collect the vehicle at the agreed time, the rental duration will not be extended nor will unused hours or days be refunded. The security deposit may under no circumstances be used as payment to extend the rental period.

2. COMPANY’S RIGHT TO WITHHOLD DELIVERY

BaoVans reserves the right not to deliver the vehicle if the company’s agent, at the time of delivery, considers that the Client is not in the proper condition to drive safely (e.g., due to attitude, behavior, visible signs of fatigue, alcohol consumption, or any other justified reason). In such cases, the contract shall be considered void due to breach by the Client, without any right to a refund. Likewise, if the Client does not meet the minimum requirements to drive the vehicle or presents invalid documentation, BaoVans will not deliver the vehicle and no refund will be issued.

3. SECURITY DEPOSIT AND PAYMENT METHOD

All rentals require a security deposit, which must be paid exclusively by physical credit card, with visible numbers, in the name of the main driver of the contract. Virtual cards, debit cards, or cash payments are not accepted. The deposit will be held until the end of the contract and subsequent inspection of the vehicle. The refund of the deposit will be processed within a maximum of 30 days from the vehicle’s return. For contracts longer than 28 days, the deposit will not be refunded to the card but via bank transfer, at the Client’s expense.

4. COVERAGES AND DEDUCTIBLES

BaoVans offers two types of coverage:

Premium coverage only reduces the deductible but does not exempt the Client from liability in cases of negligence or misuse. If BaoVans determines that damage was caused by negligent conduct, a repair estimate will be issued. The Client must pay this amount without delay. In case of late payment, a daily penalty of €20 + VAT will be applied until full settlement is received.

5. VEHICLE INSPECTION

The vehicle will be delivered in good condition, clean, and with adequate levels of fuel and fluids. The Client must check the condition of the vehicle at the time of collection and has up to one (1) hour after receiving the keys to send photos of any damage not listed in the contract. Photos must be sent by email to info@baovans.com or via WhatsApp to +34 627 93 95 14. Any damage not reported within this period will be considered the Client’s responsibility.

6. CLEANING AND MAINTENANCE

The rental price includes standard cleaning. However, if the vehicle is returned in conditions that BaoVans considers excessively dirty (mud, vomit, upholstery stains, food debris, sand, animal hair, etc.), a penalty of between €80 and €180 will be applied, depending on the level of cleaning required and vehicle downtime. Smoking inside the vehicle is strictly prohibited. If evidence of smoking is detected, a penalty of €150 will apply.

7. FUEL

The vehicle must be returned with the same fuel level as at delivery, which will be recorded in eighths (1/8) in the contract and verified through the vehicle’s dashboard indicator. Excess fuel will not be refunded. If the level is lower, a surcharge will apply according to the current rate. Misfuelling will be penalized with a minimum of €250, potentially up to the full deductible amount if mechanical damage occurs.

23. FINAL ACCEPTANCE CLAUSE

By signing the contract, the Client expressly declares having read, understood, and accepted each and every one of the conditions herein, committing to comply with them throughout the rental period. These conditions prevail over any prior communication, oral or written, unless expressly authorized by BaoVans.
